The National Development and Reform Commission and the Ministry of Commerce on December 27 unveiled the Special Administrative Measures on Access to Foreign Investment (2021 Edition) and the Free Trade Zone Special Administrative Measures on Access to Foreign Investment (2021 Edition), both of which will take effect on January 1, 2022. This marks the fifth consecutive year that China has shortened its national negative list and pilot free trade zone (FTZ) negative list.

外資準入負面清單是我國實(shí)行準入前國民待遇加負面清單管理制度的根本依據。負面清單以外的外商投資，按照內外資一致原則管理，給予國民待遇。各地區、各部門(mén)不得在負面清單之外的領(lǐng)域單獨針對外資設置準入限制。

2017年至2020年，我國連續四年修訂全國和自貿試驗區負面清單，外資準入特別管理措施分別由93項、122項減至33項、30項。2021年版全國和自貿試驗區外資準入負面清單，進(jìn)一步縮減至31條、27條。此次縮減進(jìn)一步深化制造業(yè)開(kāi)放，在自貿試驗區探索放寬服務(wù)業(yè)準入，并提高外資準入負面清單精準度，優(yōu)化外資準入負面清單管理。

【重要講話(huà)】

中國已批準《區域全面經(jīng)濟伙伴關(guān)系協(xié)定》，并申請加入《全面與進(jìn)步跨太平洋伙伴關(guān)系協(xié)定》，將在履約和談判進(jìn)程中繼續壓減外資準入負面清單，推動(dòng)農業(yè)和制造業(yè)全方位開(kāi)放，加大服務(wù)業(yè)開(kāi)放力度，依法給予內外資企業(yè)同等待遇。

China has ratified the Regional Comprehensive Economic Partnership (RCEP), and it has applied for joining the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP). In the course of RCEP implementation and CPTPP negotiation, China will continue to shorten the negative list on foreign investment, promote all-round opening-up of its agricultural and manufacturing sectors, expand the opening of the service sector, and treat domestic and foreign businesses as equals in accordance with law.
